Terms of Service

By Nelson is a brand of Burden Lake House LLC ("By Nelson," "we," "us"). These terms govern your use of our interior design and sourcing services. By requesting services, approving a quote, or making a payment, you agree to these terms.
01What we do
By Nelson is an interior design and personal sourcing service for furniture and decor. We work with clients on single projects (one room, one piece, one order) and long-term engagements (whole homes, ongoing sourcing over time).
When you text us what you're looking for, we research and vet options from brands and vendors we can source from, secure preferred or trade pricing where available, present a curated shortlist with honest guidance, and — once you approve — handle the purchasing on your behalf.
We are a design service, not a retailer. We do not sell you merchandise directly.
02How ordering works
You reach out — text us what you need, with any budget, style, or timing notes.
We source — we pull options actually worth your money and send a shortlist.
You approve a quote — every quote shows the item pricing, estimated shipping and tax, and our sourcing fee as separate line items.
We purchase as your agent — we place the order with the vendor on your behalf, using trade or preferred pricing where available. The vendor's receipt comes to you directly.
03Our fee
Our fee is a flat 5% per order, calculated on the merchandise subtotal. There is no annual commitment and no membership fee.
The fee is shown as its own line item on every quote — you'll always see exactly what it is before you approve anything. It is charged when you approve the quote and we move to purchase. If you cancel before we've placed the vendor order, the fee is refunded in full. Once the vendor order is placed, the fee is earned.
04Quotes, pricing & availability
Quotes reflect vendor pricing, availability, and lead times at the time we check them. These can change — items sell out, prices move, lead times slip. If something material changes between your approval and purchase, we'll tell you before proceeding and you can cancel or pick an alternative.
Shipping and tax on quotes are estimates until the vendor confirms final numbers against your shipping address. The final total may adjust slightly; we'll always confirm before charging.
05Purchasing as your agent — the vendor relationship
When we place an order for you, we act as your agent — an interior designer purchasing on a client's behalf. The purchase contract is between you and the vendor, not between you and By Nelson.
The vendor's own terms of sale, warranties, return policies, and shipping terms apply to every order. We'll point you to them and help you navigate them, but they govern. We are not the seller of record and not a reseller of vendor merchandise.
06Payment & how we handle your card
Our sourcing fee is collected via Stripe (payment link or saved card — your choice).
Vendor purchases are charged to your own credit card, which we enter at the vendor's checkout on your behalf. To do that, we collect your card details by phone call — never by text, DM, or email.
Your card details are stored in an encrypted password vault, used only for your orders, and deleted after your order is delivered and complete. By providing your card details, you authorize us to (a) store them as described above, and (b) charge them for vendor purchases you have approved via quote.
07Cancellations & changes
Before we place the vendor order: cancel or change anything freely, including a full refund of our fee. After we place the vendor order: cancellations, changes, and returns are subject to the vendor's policies. We'll advocate for you and handle the legwork, but we can't override a vendor's policy.
Our fee is non-refundable once the vendor order is placed, since the sourcing work is done.
08Shipping, delivery & damage
Vendors ship directly to you. Delivery timelines are estimates from the vendor, not guarantees from us. If an item arrives damaged or incorrect, tell us (and ideally photograph it) right away — we'll coordinate the claim or replacement with the vendor, but the resolution follows the vendor's policies.
09Design guidance
Our recommendations are professional design opinions based on what you tell us about your space, needs, and taste. Final decisions — including fit, scale, and measurements — are yours. When in doubt, measure twice; we're happy to sanity-check dimensions with you before you commit.
10Limitation of liability
To the maximum extent permitted by law: our total liability for any claim related to our services is limited to the sourcing fees you paid us for the order in question. We are not liable for vendor delays, stock issues, price changes, shipping damage, or manufacturer defects — those sit with the vendor under their terms. We are not liable for indirect, incidental, or consequential damages.
11Privacy
We use your information — contact details, project notes, order history — only to provide our services. We don't sell your information. Card details are handled as described in Section 06 and never shared except to process your approved purchases.
12Changes to these terms
We may update these terms as the service evolves. The version in effect when you approve a quote governs that order. Continued use of our services after an update means you accept the updated terms.
13Governing law
These terms are governed by the laws of the State of New Jersey.
